Acceptable Terms on Fair Use
The Acceptable Terms on Fair Use for MobileLINK Asia’s unlimited calling is aligned with industry practice of telecommunications providers all over the world. It is intended to ensure that all customers get to equally share an enjoyable experience using MobileLINK Asia’s services. As such, the Acceptable Terms on Fair Use may be used to protect MobileLINK Asia’s customers against entities or persons utilizing MobileLINK Asia’s services in a manner that runs counter to the intent of the service, fraudulent, or exceeding normal standards of use.
In your purchase or use of our products and services, you agree to our Acceptable Terms on Fair Use and agree to be bound by the policy.
Please see below the terms relating to the unlimited services that you have subscribed for.
1. Available to active MobileLINK Asia’s subscribers
2. Applicable to MobileLINK Asia to other network calls
3. MobileLINK Asia’s provides unlimited calls to be used from your private, personal, non-commercial purposes.
MobileLINK Asia’s shall implement policies to ensure that all subscribers get to equally share an enjoyable service experience and receive fair and equitable access. This policy is designed to protect those who might be affected by the few subscribers who use the unlimited services for activities other than its intended use. Acceptable Terms on Fair Use applies:
a. to the use of service for spam or unsolicited bulk calling like political and promotional advertisements, financial loans or recruitments
b. to the use of service for fraudulent calls or bogus promotional offers
c. if your usage of unlimited calls is excessive or unreasonably high
Your usage of an unlimited service is excessive as defined below:
a. It is unreasonable/excessive if your usage adversely affects the MobileLINK Asia network and another MobileLINK Asia subscriber’s use or access to MobileLINK Asia services.
b. Excessive use means calls or text usage per day is significantly higher than one’s normal usage. Currently calculated at four times the duration of our average user.
If your use of the plan is excessive or unreasonable we will contact you by email, using the contact details you have provided to us. If after our request your usage continues at a similar level we may change your plan, then charge you at the rates for that plan and backdated to when we made contact. Your subscription may also be suspend or canceled.
Your usage of an unlimited service is unreasonable as defined below:
Without restricting what is meant by ‘unreasonable’ we will supply the service for the purpose of you making and receiving calls on our network for your personal use.
We will consider unreasonable use of the service to be:
Using the service for business purposes.
If you use a device that reroutes calls to/from our network or the network of another supplier.
Wholesale any service on our network.
In contrast to the above sub-clauses we may in our absolute discretion give our consent to this type of behavior, subject to conditions and in writing.
We further consider your use of the service to be unreasonable if you reduce or limit the ability of other customers to access our network as you:
engage in the bridging of conference calls;
use the service to link two or more communication devices together for the purposes of providing a permanent or semi-permanent circuit;
use the service for any other purpose than the predominant function of person-to-person voice communication.
Without reducing or restricting our rights, where we consider your use unreasonable we may:
Suspend or cancel your service.
Immediately and without any prior warning or notice given to you.
If MobileLINK Asia reasonably suspects that you are not acting in accordance with the Acceptable Terms on Fair Use, MobileLINK Asia reserves the right to suspend your subscription and charge you under regular rates, change your subscription plan, or disconnect your account.
We reserve the right to vary the Acceptable Terms on Fair Use without prior notice and at our discretion from time to time
